1: Limitation of liability;
Essex Mushrooms, nor any of its officers, directors and employees, cannot be held liable for anything arising out of or in any way connected with your use of this Website. Essex Mushrooms, including its officers, directors and employees shall not be held liable for any indirect, consequential or other liability arising out of or in any way related to your use of this Website.

2. Privacy;

3: Refunds and Returns;
You agree to be bound by our refunds and returns policy which can be found here https://mushroomkits.co.uk/refund_returns/ and which governs all sales and purchases made through this website.

4: Product descriptions;
All product descriptions are correct to the best of our knowledge. In the event of inaccuracies being discovered we will alter descriptions as soon as we are made aware of an error. For commercial reasons we do not divulge the exact percentage composition of some products such as (CVG substrates). In the event that a customer purchases a product which is not as described we will refund the purchase provided the item is returned to us unopened and unused.

5: Prices;
Prices are subject to change without notice. We reserve the right to decline or cancel any order at our discretion. In the event of cancellation of a paid order, the amount paid will be refunded to the same card/paypal account that the payment was received from.

6. Payment;
Payments may be made by several means and we reserve the right to add or remove payment options at our discretion and without notice. We only accept payment by secure payment methods which will typically include credit and debit cards which will be processed by Stripe. We may also include payment options including Paypal. We cannot accept postal payment or postal orders. Payment is due on all orders at the time of order and if immediate payment fails the order will not be processed.

7. Delivery;
We can only accept orders from customers residing in the UK and for orders that are delivered to the UK. If a discrepancy found between billing and delivery details, we may choose to cancel the order at our discretion for our own protection. Delivery may be free according to promotions at any given time but if delivery is not free, delivery charges will be displayed during order checkout.

8. Dispatch and Shipping Times;
Some items we sell are made to order – typical examples being sterilised / processed items such as agar dishes, sterilised grain and substrates – and responsible preparation of these items may take up to 3 working days. Unless a customer opts to pay for an express delivery option, our typical dispatch method will be a tracked or signed-for service offered by UK Royal Mail. In the event that a delay occurs we will inform the customer by email.

9. Returns;
Customers are responsible for paying return postage for any items returned to us for refund or exchange. Tracked delivery should always be used as proof of delivery is the only proof of postage we can accept in the case of any dispute or non-arrival of goods. To be eligible for a return, you must first submit a returns request identifying the item and explaining why a refund is being requested. To submit a returns request, log in using your account details and you will find a link to the returns form on the main menu.

10. Order cancellation
Most of the items sold on this site are either personalised/made to order or highly perishable (items such as agar which deteriorate rapidly) and, once received and we have started to process the order, no cancellation is possible. This refusal is standard and permitted under UK consumer law. In the case of other standard physical products such as syringe sets, empty sterile packs of petri dishes, pressure cookers and other similar items we may stock, your rights to cancel under consumer law is not affected.

11. Warranty
Most of the products sold on this site are sold without warranty but where a warranty exists details of that warranty will be included in the item’s sales description.

12. Governing Law & Jurisdiction;
These Terms will be governed by and interpreted in accordance with the laws of the United Kingdom, and you submit to the non-exclusive jurisdiction of the courts located in the UK for the resolution of any disputes.
